Acceptance of terms

These Terms & Conditions govern your use of the Nest Pointe Logistics website and any purchase, bid or request you submit through it. By browsing, registering, bidding or buying, you agree to these terms.

Eligibility

You must be at least 18 years old and able to enter a binding contract. Business buyers represent that they are authorized to act for the business named on the account or order.

Accounts

You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your credentials confidential and tell us promptly if you believe your account has been used without permission. We may suspend or close accounts for non-payment, abuse, fraud or violation of these terms.

Product and inventory listings

Listings describe inventory to the best of our knowledge at the time of publication. Photos may be representative rather than of the exact unit. Descriptions, quantities, weights, counts and locations may be corrected at any time. Inventory is offered subject to prior sale.

Product condition

Each listing states a condition grade. Unless expressly stated in writing, all merchandise is sold as-is and where-is with no warranty of merchantability or fitness for a particular purpose. Untested, customer-return and salvage merchandise may require testing, cleaning, repair or disposal.

Pricing

Prices are shown in US dollars and may change without notice until an order is confirmed. Taxes, freight, handling and any applicable fees are additional unless stated. We may correct pricing or listing errors and cancel affected orders with a refund of amounts paid.

Orders

Submitting an order or order request is an offer to buy. An order is accepted only when we confirm it in writing. We may decline or limit any order, including for availability, pricing errors, suspected fraud or resale-restricted merchandise.

Payment

Accepted payment methods and timing are shown at checkout or on your invoice. Payment must clear before merchandise is released, picked up or shipped. BUSINESS REVIEW: confirm accepted payment methods, deposit requirements and payment deadlines.

Pickup and fulfillment

Local pickup is available in the Aurora–Batavia area. The exact pickup location, time window and site instructions are provided privately after purchase or a confirmed pickup appointment — through your order confirmation email/SMS or your account. Buyers are responsible for bringing suitable transportation, equipment and help to load. Merchandise not collected within the stated window may incur storage fees or be treated as abandoned. Shipping and freight

Where shipping or freight is available, quoted charges are estimates until booked. Delivery dates are not guaranteed. Risk of loss passes on delivery to the carrier unless stated otherwise. Inspect all shipments on arrival and note damage on the delivery receipt; unnoted damage may not be claimable with the carrier.

Returns and refunds

Because merchandise is sold as-is, sales are generally final. Where a listing was materially misdescribed, contact us promptly with photos and your order number so we can review. BUSINESS REVIEW: confirm the claim window, evidence requirements and remedy (replacement, credit or refund).

Wholesale pallets

Pallet contents vary. Item counts, categories and condition mixes are approximations unless a manifest states otherwise. Pallets are sold as a whole unit and are not eligible for item-level substitution or cherry-picking.

Manifests and estimated retail values

A manifest reflects what was recorded at the time the load was assembled. Contents may shift in handling and transit. Estimated retail values are reference figures only. They are not appraisals, resale prices, or a representation of resale value, sell-through, or profit.

Auctions

Auction lots list a starting bid, bid increment and closing time. We may correct lot details, extend or reschedule closing times, or withdraw a lot before it closes. Bids placed near the close may extend the closing time where anti-sniping rules apply.

Bidding obligations

Every bid is a binding offer to buy at that amount. Bids cannot be retracted once placed. Bidding on your own lots, coordinating bids with others, or bidding without intent or ability to pay is prohibited and may result in account closure.

Winning bids

The highest valid bid at close wins, subject to any reserve stated in the lot. We will notify the winner and issue an invoice with the winning amount plus any applicable taxes, fees and freight.

Payment after winning

Winning invoices must be paid within the period stated on the invoice. Unpaid lots may be relisted or awarded to the next bidder, and the defaulting account may be suspended. BUSINESS REVIEW: confirm the payment deadline and any buyer premium or default fee.

Inventory availability

Listing an item does not reserve it. Inventory requests, buyer network membership and quotes do not guarantee allocation on any load. If ordered inventory becomes unavailable, we will offer a substitute where possible or refund the amount paid.

Prohibited use

• Using the site for unlawful purposes or to violate resale, export or licensing restrictions.
• Interfering with the site, scraping at scale, or attempting unauthorized access.
• Submitting false information, impersonating others, or manipulating auctions.
• Reselling recalled, unsafe or counterfeit merchandise, or removing safety or condition labeling.

Intellectual property

The Nest Pointe Logistics name, logo, site design, written content and photography are our property or licensed to us and may not be copied or used without permission. Third-party brand names appearing on merchandise belong to their owners and their use here is descriptive only; no affiliation or endorsement is implied.

Disclaimers

The website and all merchandise are provided as-is and as-available without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that listings, manifests, availability or pricing are error-free, or that the site will be uninterrupted.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or lost-profit damages. Our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. BUSINESS REVIEW: confirm venue, and whether arbitration or a class-action waiver should be added.

Changes to terms

We may update these terms. The current version is always posted on this page with a revised date, and it applies to orders and bids placed after it is posted.
