DRAFT — ADMIN REVIEW REQUIRED
This document is an internal working draft prepared by Nest Pointe staff. It has not been reviewed by an attorney. It is published for review purposes only and does not constitute legal advice.
Bidder registration
You must have a registered account in good standing to bid, and you must accept these Auction Terms at registration. We may require verification before enabling bidding and may decline or suspend bidding privileges for non-payment, misrepresentation, or attempted manipulation.
Bids are binding
Every bid you place is a binding offer to purchase that lot at that price. Bids cannot be retracted. You are responsible for bids placed from your account, including bids you place in error, so review the lot, condition, quantity, and collection method before bidding.
Bid increments and validation
Each lot displays a current high bid and the minimum next bid. Bids below the minimum increment are rejected. All bid validation, increment enforcement, and high-bidder determination happen on our servers; the server record is the authoritative record of the auction.
Reserves and closing
A lot may carry a reserve; if the reserve is not met, the lot does not sell. Lots close at the posted end time. Where anti-sniping extension is enabled on a lot, a bid placed in the final moments extends the close time, and that behavior is shown on the lot page.
Winner obligations and payment deadline
The high bidder at close is obligated to complete the purchase. An invoice is issued after close showing the winning amount plus shipping or freight and any applicable tax. Payment is due within the window stated on the invoice. If you cannot meet the deadline, contact us before it passes.
Unpaid lots
If a winner does not pay by the deadline, the lot may be cancelled, relisted, or offered to the next bidder, and bidding privileges may be suspended. No punitive fee, buyer's premium, or penalty is charged unless it is disclosed on the lot page before bidding opens.
Collection and shipping
Each lot states whether it is pickup, parcel, or freight. Collection windows, storage rules, and freight quoting follow the Local Pickup Policy and the Freight Shipping Policy.
Condition, inspection and no returns
Auction merchandise is sold as-is. Photographs, counts, and manifests are provided as accurately as we can, and estimated retail values are references only. Liquidation, pallet, bulk and auction merchandise is sold as-is and where-is. Retail values referenced anywhere on this site are estimates for comparison only and are not an appraisal, a resale price, or a promise of any outcome. Auction wins are not returnable based on condition or resale outcome.
Technical errors
If a system, connectivity, or configuration fault materially affects an auction — a lot that fails to close, a bid that is not recorded, a duplicate bid, or an incorrect increment — we may correct the record, reopen or extend the lot, or void and relist it. We are not liable for a bid you were unable to place because of an interruption on either side.
Modification and cancellation of auctions
We may correct a listing, add or remove a lot, extend or shorten a listing period, or cancel an auction before close where merchandise is damaged, sold in another channel, misdescribed, or unavailable. If a lot is cancelled after you have paid, you receive a full refund.
