DRAFT — ADMIN REVIEW REQUIRED

This document is an internal working draft prepared by Nest Pointe staff. It has not been reviewed by an attorney. It is published for review purposes only and does not constitute legal advice.

This is liquidation merchandise, not retail

Pallets, bulk lots, and truckloads are wholesale liquidation merchandise sold to business buyers. They are not comparable to individual retail products and are not covered by the retail return window in the Returns & Refund Policy.

Manifests

Where a manifest is available it is provided as received from the source and is described as manifested. Where no manifest exists, the listing is described as unmanifested and only category, condition mix, and approximate piece or pallet count are represented.

Estimated quantities

Piece counts, unit counts, and weights on a manifest or listing are estimates. Actual counts commonly vary. A variance of up to 10% from a stated estimate is normal for this merchandise and is not treated as a shortage.

Estimated and reference retail values

Any "estimated retail," "MSRP," or "reference value" figure is a comparison point drawn from source data or public listings at a point in time. It is not an appraisal, not a current market price, and not what the merchandise will sell for. Liquidation, pallet, bulk and auction merchandise is sold as-is and where-is. Retail values referenced anywhere on this site are estimates for comparison only and are not an appraisal, a resale price, or a promise of any outcome.

No guaranteed resale value or profit

Nest Pointe does not guarantee resale value, sell-through rate, margin, income, or profit on any load. Outcomes depend on your channel, pricing, costs, timing, and effort. Do not purchase a load on the assumption of a specific return.

Condition

Loads may contain customer returns, shelf pulls, overstock, damaged packaging, missing accessories, and non-working units unless the listing states otherwise. Condition definitions apply as published. Working percentages are not guaranteed on untested merchandise.

Inspection

Inspection by appointment is available on most loads before purchase, and we encourage it. Purchasing without inspecting is at your discretion, and photos and manifests are not a substitute for inspection.

Freight and pickup

Pallet and bulk merchandise ships by freight or is collected. Freight is quoted per load under the Freight Shipping Policy, and pickup follows the Local Pickup Policy, including our loading and safety rules.

Shortages and discrepancies

Report a material shortage or a load that does not match its description within 48 hours of pickup or delivery, with photos and a piece count. Verified material discrepancies are resolved by a partial refund, a credit, or replacement merchandise at our option. Claims based on condition mix, resale performance, or estimated retail value are not accepted.

Business buyer status and resale

You are responsible for any resale registration, tax registration, licensing, and brand or platform restrictions that apply to reselling merchandise. Some merchandise may not be resold as new, and some brands restrict resale channels.
